General Terms and Conditions of Sale
Last updated: September 2026
These general terms and conditions of sale (the “Terms”) apply to any order placed on the site mama-pop.com (the “Site”). By placing an order, you confirm that you have read and accepted them. They are supplemented by our Return, Refund, and Cancellation Policy, our Shipping Policy, and our Privacy Policy.
1. Who we are
The Site is operated by Mama-Pop, a micro-enterprise located at 60 rue François 1er, 75008 Paris, France. Email: contact@mama-pop.com.
2. Products
The products offered are those presented on the Site at the time of your visit, subject to availability. Each product page describes the essential characteristics of the product. We do our utmost to ensure that photos and descriptions are accurate; however, slight color differences may occur depending on your screen settings.
3. Prices
Prices are indicated in Canadian dollars (CAD). The total price of your order, including all applicable charges, is presented to you before you confirm your order. Shipping is free throughout Canada. The applicable price is the one displayed at the time you place your order.
4. Ordering
To order, add products to your cart, provide your contact and shipping information, and select your payment method. Before confirming, a summary allows you to check your order and correct any errors. The contract is concluded when you confirm the order and your payment is accepted. An order confirmation is then sent to you by email; please keep it.
5. Payment
Payment is made at the time of the order by credit card, PayPal, or any other method displayed at the payment stage. Transactions are processed by secure payment providers; Mama-Pop never has access to your full card numbers.
6. Shipping
We ship throughout Canada. Shipping is free, with no minimum purchase required.
Your order is processed in 1 to 2 business days, then delivered in 7 to 9 business days, for a total of 8 to 11 business days from the order confirmation. A tracking number will be sent to you by email upon shipment.
If your order is not delivered within 30 days of the expected delivery date, you may cancel it in accordance with the terms of Article 7.
Upon receipt, check your package. In the event of a damaged package, missing product, or error, email us at contact@mama-pop.com with your order number and, if possible, photos. If the tracking shows that your package has been delivered but you have not received it, write to us: we will open an investigation with the carrier and propose a solution, such as re-shipping the product at our expense.
If the package is returned to us due to an inaccurate or incomplete address, or because it was unclaimed, we will offer you, at your choice, re-shipment or a refund, minus the shipping costs incurred.
7. Statutory right of cancellation
The Consumer Protection Act (sections 54.1 et seq., regarding distance contracts) allows you, among other things, to cancel your order:
- within 7 days of receiving your copy of the contract, if the information that the law requires us to provide before the order was not provided or was not provided correctly;
- within 30 days of the conclusion of the contract, if your copy of the contract was not provided to you within 15 days of its conclusion;
- as long as the product has not been delivered to you, if it is not delivered within 30 days of the expected delivery date or, in the absence of a date, within 30 days of the conclusion of the contract.
To cancel, notify us by email at contact@mama-pop.com. We will refund all sums paid within 15 days of the cancellation, in accordance with the terms provided by law. If you paid by credit card and we do not provide a refund, the law allows you to request a payment reversal from your card issuer.
These rights are in addition to our 90-day return guarantee (Article 8).
8. Returns: 90-day guarantee
You may return a product to us for any reason within 90 days of delivery, whether it does not suit you or you have simply changed your mind. The product must be unused, in its original packaging, and accompanied by proof of purchase. Full conditions (excluded products, procedure, return costs, and refund times) are available in our Return, Refund, and Cancellation Policy.
9. Warranties
Legal warranties. All products sold on the Site benefit from the warranties provided by the Consumer Protection Act and the Civil Code of Quebec. The product must be fit for the purpose for which it is normally intended, for a reasonable duration given its price and conditions of use. It must also be free of hidden defects. These warranties apply at no cost, regardless of whether you have an additional warranty.
Mama-Pop commercial warranty. In addition to legal warranties, and without limiting them, we replace any defective part for 90 days following the date of purchase, under normal conditions of use, excluding failure caused by an external factor.
To exercise a warranty, write to us at contact@mama-pop.com, indicating your order number and the identified problem. When a product is defective or non-compliant, we will replace it or, if that is impossible, refund you; return shipping costs will then be covered by us.
10. Liability
Mama-Pop is not responsible for delays or non-performance caused by a force majeure (Article 11). Nothing in these Terms limits the rights granted to you by law, nor the liability that the law prohibits excluding.
11. Force majeure
An unforeseeable and irresistible event beyond the control of the parties (force majeure within the meaning of Article 1470 of the Civil Code of Quebec) suspends the execution of the order. If it lasts beyond 90 days, either party may cancel the order in writing; the sums paid for undelivered products will then be refunded to you.
12. Personal information
The information collected during your order is processed in accordance with our Privacy Policy.
13. Customer service and complaints
For any questions or complaints, write to us at contact@mama-pop.com with your name and order number. If a dispute is not resolved, you can inform yourself about your rights through the Office de la protection du consommateur (www.opc.gouv.qc.ca) and, if necessary, turn to the Small Claims Division of the Court of Quebec.
14. Applicable law
These Terms are governed by the laws applicable in Quebec. They do not deprive you of any protection granted by the mandatory provisions of the law of your place of residence. Any dispute may be brought before the competent court of your place of residence.
15. Language
These Terms and the documents related to your order are written in French.
16. Changes and severability
We may modify these Terms at any time. The Terms applicable to your order are those in effect at the time you placed it. If a provision is found to be invalid, the others remain in force.
